Discharging Taxes

In bankruptcy, taxes are dischargeable if they meet all of the following conditions:

  • Deadline for paying the taxes is more than three years ago
  • Tax return was filed at least two years ago
  • No tax assessment in the last 240 days
  • No allegations of tax fraud or tax evasion

However, if the taxes do not meet these conditions, you may opt to pay them back over time with a chapter 13 bankruptcy. As the chapter 13 pays your debts pro rata among all your creditors, with higher priority given to taxes, you could pay off your taxes in three to five years without having to worry about your other debts.
